Man Given Months To Live Sues After Not Dying

A grandfather who went on a massive spending spree when doctors told him he would die is taking legal action against the NHS after learning he had been misdiagnosed.

John Brandrick, from Newquay, Cornwall, was told he had pancreatic cancer two years ago after scans revealed a 7cm tumour.

The 62-year-old said he was told by doctors at the Royal Cornwall Hospital in Treliske that he only had a short time left to live.

So he quit his job and stopped paying his mortgage, instead splashing out on a lavish lifestyle of hotels, restaurants and holidays.

Then the hospital told him that he was actually suffering from non-fatal pancreatitis.

Mr Brandrick said that in the year he thought he was dying he spent everything and now he faces losing his house.

He told Sky News: “I’m really pleased I’ve got a second chance in life. But if you haven’t got any money - it was my fault, I spent it all - they should pay something back.”

Mr Brandrick, who confirmed he had been given paperwork which said he had a short time to live, added: “I gave all my clothes away to the charity shop.

“I only kept summer wear because that was all I’d got left to live.

“I kept a suit, a tie, a shirt and a pair of shoes to be buried in because I arranged all my own funeral.”

The Royal Cornwall Hospital’s NHS Trust said there was “no clear evidence of negligence” in the case.

A spokesman said: “Whilst we do sympathise with Mr Brandrick’s position, clinical review of his case has not revealed that any different diagnosis would have been made at the time based on the same evidence.”

I was just reading that in “The Sun” newspaper...5 minutes ago…

He hasnt a case...the diagnosis was made to the best of the available knowledge, at the time…

There is no fault on the doctors part.

I must admit though, if a doctor told me I had terminal cancer I’d probably do the same smile (spend like a bastard that is, not sue the NHS)! smile

It`s the bleedin claims culture again in this country-so he`s annoyed he`s still alive...well,let`s terminate him and save on the pension...s everyone`s happy....sorry,just seen my P60 today-I pay way too much tax to moaning sods

Don’t disagree with you at all mate. Occasionaly we go the local Wetherspoons for a working lunch and it’s always frequented by the same bunch of spongers and losers who spend all day pissing our hard earned money up the wall.

The MD recently enquired about an employee private health scheme. Rather then a reduction any NI payments (as we’d be reducing the burden on the NHS) we’d have to pay more tax as the governement see it as a ‘benefit in kind’! Makes no sense at all mad

lol.. tbh the bloke has only done wt we would have all done in the same shoes.  If he really does have nothing, declare bankruptcy, go on a day trip to france, on the way back, loose his passport, seek asylum, get a new house, car and phone.  Sorted. lol
